These Terms of Service ("Terms") govern your use of the Anthos mobile application ("the App," "Anthos," "we," "our"). By downloading, installing, or using Anthos, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Medical Disclaimer — Read Carefully
Anthos is not a medical device. Anthos is not a diagnostic tool. Anthos does not provide medical advice.
Anthos provides general wellness information based on publicly available environmental data including pollen counts, air quality indices, and weather conditions. This information is provided for educational and informational purposes only.
Anthos does not:
- Diagnose any medical condition, disease, or allergy
- Recommend, prescribe, or suggest any medication, treatment, or therapy
- Replace the advice, diagnosis, or treatment of a licensed healthcare professional
- Serve as a substitute for professional medical judgment
- Make any claims about the prevention, treatment, or cure of any condition
The severity levels, care plan suggestions, and daily readings provided by Anthos are general wellness guidance only. They are not personalized medical recommendations. "Low," "Moderate," "High," and "Extreme" severity labels are based on general population thresholds published by environmental monitoring agencies and do not account for your individual medical history, medications, or health conditions.
The medication log feature is a voluntary personal tracker only. Anthos does not recommend medications, dosages, schedules, or changes to any treatment plan. Always follow guidance from your own physician or pharmacist.
You should always:
- Consult a licensed healthcare professional for medical advice
- Seek immediate medical attention for severe allergic reactions or breathing difficulties
- Follow your prescribed treatment plan as directed by your healthcare provider
- Not delay seeking medical care based on information provided by Anthos
By using Anthos, you acknowledge and agree that you will not rely on the App as a substitute for professional medical advice, diagnosis, or treatment.
2. Eligibility
You must be at least 13 years old to use Anthos. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. License and Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Anthos on a personal iOS device that you own or control, solely for your personal, non-commercial use, subject to these Terms.
You may not:
- Copy, modify, distribute, sell, lease, or sublicense the App or its content
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices, labels, or marks
- Use the App for any illegal, harmful, or unauthorized purpose
- Attempt to gain unauthorized access to our systems, APIs, or services
- Use automated systems, bots, or scripts to interact with the App
- Misrepresent Anthos as a medical device or diagnostic tool in any context
4. User Data and Privacy
Your use of Anthos is also governed by our Privacy Policy. By using the App, you consent to the data practices described in the Privacy Policy.
Key points:
- Health and symptom data is stored exclusively on your device
- We do not collect personally identifiable information
- Location data is used transiently for environmental data retrieval only
- We do not sell, share, or monetize your data
5. AI-Generated Content
Anthos uses artificial intelligence (Anthropic's Claude) to generate personalized daily readings based on environmental data. You acknowledge that:
- AI-generated content is provided for informational purposes only and does not constitute medical advice
- AI-generated content may occasionally contain inaccuracies, generalizations, or errors
- You should not rely solely on AI-generated content for health or safety decisions
- AI-generated readings reflect environmental conditions and general wellness guidance, not personalized medical recommendations
- We do not guarantee the accuracy, completeness, or timeliness of AI-generated content
6. Environmental Data Accuracy
Pollen counts, air quality indices, weather data, and forecasts are sourced from third-party providers (Google APIs) and publicly available environmental monitoring networks. You acknowledge that:
- Environmental data may not perfectly reflect conditions at your exact location
- Pollen counts are measured at monitoring stations and extrapolated to surrounding areas
- Data may be delayed, incomplete, or temporarily unavailable
- Forecasts are predictions and may not match actual conditions
- Anthos does not guarantee the accuracy, completeness, or reliability of any environmental data
- You should not rely solely on Anthos data for safety-critical decisions
7. App Store Terms
Your use of Anthos is also subject to the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement ("Standard EULA"). In the event of a conflict between these Terms and Apple's Standard EULA, Apple's terms shall govern to the extent required.
You acknowledge that:
- These Terms are between you and Anthos, not Apple
- Apple has no obligation to furnish maintenance or support services for the App
- Apple is not responsible for any claims relating to the App, including product liability, legal compliance, or intellectual property matters
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Anthos, its owners, officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Personal injury, illness, or adverse health outcomes
- Loss of data or information
- Loss of profits, revenue, or business
- Emotional distress
- Any damages arising from your reliance on the App's content, data, or AI-generated readings
Whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims arising out of or relating to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim, or fifty dollars ($50.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that:
- The App will be uninterrupted, error-free, or free of viruses or harmful components
- Environmental data will be accurate, complete, or current
- AI-generated content will be accurate or appropriate for your individual circumstances
- The App will meet your specific health or medical needs
- Defects will be corrected
10. Indemnification
You agree to indemnify, defend, and hold harmless Anthos, its owners, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the App
- Your violation of these Terms
- Your reliance on the App's content for medical or health decisions
- Any claim that your use of the App caused injury, illness, or harm to you or any third party
- Your representation of Anthos as a medical device or diagnostic tool
11. Intellectual Property
All content, features, functionality, design, text, graphics, logos, icons, and software in Anthos are owned by Anthos and are protected by United States and international copyright, trademark, and other intellectual property laws. The Anthos name, logo, and wordmark are trademarks of Anthos.
12. Termination
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your license to use the App is immediately revoked. Provisions that by their nature should survive termination (including Sections 1, 8, 9, 10, and 11) shall survive.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to modified Terms, stop using the App and uninstall it.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Denton County, Texas. You agree to waive any right to a jury trial or to participate in a class action.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Anthos regarding your use of the App and supersede all prior agreements, representations, and understandings.
